Will divorce doom your startup?

Innovation goes hand in hand with new and exciting startup possibilities, and that has been a huge part of San Francisco’s growth over the years. However, the time and energy it takes to run a new enterprise can put a marriage in deep trouble.

As anyone who has ever worked in a startup knows, a company’s fortunes tend to depend on the owner’s every action. If those actions lead to divorce, the future of the company can hang in the balance. However, there are options for you to protect yourself and your business.

Divorce doesn’t have to hurt

A healthy relationship is always the goal and that takes communication and time, but even with all the time in the world and great communication, you still may be headed for divorce. If that’s the case, there are steps you can take to ensure that you have a healthy divorce:

  • A prenuptial or postnuptial agreement: Whether you are about to be married or already are, a pre- or postnuptial agreement, can force a needed conversation about finances during marriage and set clear ground rules should your relationship change.
  • Collaborative process: Should you decide on divorce, the collaborative process, which involves teams of professionals (legal, financial, mental health experts) working for a mutually acceptable outcome, may be the best option in situations where influence over the ultimate outcome and a level of privacy is desired (by staying out of the adversarial court system).
  • MediationAlternatively, mediation also allows you to retain a greater level of control and understanding of the terms of your divorce and to keep the proceedings largely private from public eyes. It allows you to work directly with a mediator to come to a mutually beneficial agreement.

Long marriages, high assets and children can all complicate a divorce even if you are committed to alternative dispute resolution. However, a willingness to work through it rather than fighting can make a huge impact for you.

You do have a choice

A less contentious divorce will go a long way to protecting your company and the people who depend on you.
